Laying Evidentiary Foundation: The Four-Step Courtroom Ritual (FRE 901)

The Universal Four-Step Ritual

Every trial lawyer must memorize the fundamental procedural sequence for introducing documentary evidence under Federal Rule of Evidence 901 and state evidence codes. Skipping any step invites an immediate objection from opposing counsel.

The 4-Step Examination Script

1. Step 1: Mark for Identification & Show Counsel:
   "Your Honor, I ask that the clerk mark this two-page document as Plaintiff's Exhibit 12 for identification... May the record reflect I am showing a copy to opposing counsel."
2. Step 2: Present to the Witness:
   "Permission to approach the witness?... Mr. Davis, I am handing you what has been marked as Plaintiff's Exhibit 12 for identification. Do you recognize this document?"
3. Step 3: Lay the Foundation (Authentication):
   "What is it?" — [Witness answers: "It's the signed agreement dated October 12, 2024."]
   "How do you recognize it?" — ["That is my signature at the bottom, and I prepared this on company letterhead."]
   "Is it in substantially the same condition today as when you executed it?" — ["Yes, it is."]
4. Step 4: Offer into Evidence:
   "Your Honor, Plaintiff offers Exhibit 12 for identification into evidence as Plaintiff's Exhibit 12."
   [Judge asks opposing counsel for objections; if none or overruled: "Exhibit 12 is admitted."]
