Digital Evidence Authentication Challenges

Screenshots of text messages, WhatsApp chats, and social media posts are the lifeblood of modern litigation. However, opposing counsel frequently objects on grounds of lack of authentication, hearsay, or potential digital alteration.

Authenticating Text Messages (FRE 901(b)(4))

Under Federal Rule of Evidence 901(b)(4), evidence may be authenticated by "distinctive characteristics and the like, taken together with all the circumstances." To authenticate a text screenshot, elicit testimony proving:

• The phone number associated with the text corresponds to the opposing party;
• The content of the messages discusses private facts known only to the sender and recipient;
• Subsequent real-world conduct conformed to the promises made in the text messages.

Self-Authenticating Digital Records (FRE 902(14))

Under FRE 902(14), certified data copied from an electronic device or system is self-authenticating if accompanied by a formal certification from a qualified forensic examiner verifying the digital hash values (e.g., SHA-256) match the original source.
